General Terms and Conditions

1. General
1.1 These General Terms and Conditions apply to all offers, orders, deliveries, and agreements between Jesa Piercing BV, located at Keizersveld 70 c, 5803 AN, Venray, the Netherlands, registered with the Chamber of Commerce under number 96536543 (hereinafter: "Seller"), and business customers (hereinafter: "Customer").
1.2 Deviations from these conditions are only valid if agreed upon in writing.
1.3 By placing an order, the Customer explicitly agrees to these General Terms and Conditions.
2. Offers and Pricing
2.1 All offers made by the Seller are non-binding and subject to availability.
2.2 Prices are exclusive of VAT and shipping costs, unless explicitly stated otherwise.
2.3 The Seller is not bound by apparent errors or mistakes on the website, quotations, or order confirmations.
2.4 The Seller reserves the right to modify prices at any time. Updated prices take effect immediately upon publication on the website.
3. Orders and Payment
3.1 A binding agreement is established upon confirmation of the Customer’s order by the Seller.
3.2 Payments must be made via the payment methods provided by the Seller.
3.3 In case of late payment, the Customer will automatically be in default. The Customer will be liable for all legal collection fees and statutory interest from the due date.
3.4 The Seller reserves the right to require payment in advance or refuse orders if there are concerns regarding the Customer's creditworthiness.
3.5 Unless otherwise agreed, the standard payment term is 14 days from the invoice date.
4. Delivery
4.1 Deliveries will be made to the address provided by the Customer unless otherwise agreed in writing.
4.2 Delivery times stated by the Seller are indicative only. Exceeding these delivery times does not entitle the Customer to compensation or cancellation of the order.
4.3 The risk of loss or damage to the goods transfers to the Customer upon handover to the carrier.
4.4 The Seller reserves the right to make partial deliveries. Any additional shipping costs resulting from backorders due to stock shortages will be covered by the Seller.
5. Products and Hygiene
5.1 All piercings and related products sold by the Seller are intended solely for professional use. The Customer is responsible for ensuring correct usage and resale.
5.2 For hygiene reasons, opened packaging or used items cannot be returned.
5.3 The Customer is responsible for adequately informing end-users about correct product usage and potential risks associated with piercing products.
6. Returns and Complaints
6.1 Returns will only be accepted after prior written approval by the Seller. For detailed return procedures, see our [Return Policy].
6.2 Complaints about incorrect or damaged products must be reported in writing within 48 hours of receipt.
6.3 In the case of justified complaints, the Seller will offer an appropriate solution, such as replacement products or credit.
6.4 Return shipping costs are borne by the Customer, except in cases where the error lies with the Seller.
7. Liability
7.1 The Seller is not liable for any direct or indirect damage resulting from the use of its products.
7.2 In all cases, the Seller’s liability is limited to the amount of the corresponding invoice.
7.3 The Seller is not liable for delays or damages resulting from circumstances beyond its control (force majeure), including strikes, supplier issues, or extreme weather conditions.
8. Retention of Title
8.1 All goods delivered remain the property of the Seller until full payment has been received.
8.2 The Customer is not entitled to pledge or encumber goods in any way until ownership has been transferred.
9. Intellectual Property
9.1 All images, texts, and designs on the Seller’s website are the property of the Seller and may not be used or reproduced without explicit written consent.
9.2 In case of infringement of intellectual property rights, the Seller reserves the right to take legal action and seek compensation for damages.
10. Governing Law and Disputes
10.1 All agreements are exclusively governed by Dutch law.
10.2 Any disputes will be submitted to the competent court in Roermond, the Netherlands.
10.3 Parties will first seek an amicable settlement of disputes through mediation before resorting to litigation.
